Law Practice Experience

Private law practice experience includes civil and appellate litigation in the areas of employment, commercial, education and public utility law. As University General Counsel, I advised senior university officials and counseled the purchasing, procurement, construction, research, student affairs, public television and other departments. As a judge on the state’s intermediate appellate court, I heard over 1000 appeals in all areas of law including cases involving breach of contract, personal injury, medical malpractice, real estate administrative law, domestic relations, insurance coverage, civil rights, securities, intellectual property, constitutional law and employment.

Arbitration and Related ADR Experience

Experienced arbitrator in over 100 commercial, construction, employment and class arbitrations with amounts in controversy up to $100 million. Commercial disputes arbitrated have included virtually all areas of the law including disputes in the health care industry, medical partnerships, pharmaceuticals, insurance claims, and banking. I am one of a small group of trainers for the AAA Arbitrator II training, and a panelist in the new AAA e-commerce arbitration program. Arbitration experience includes participating in a mass claims arbitration involving thousands of state employees and serving as the sole arbitrator in four regional and national class arbitrations. 

I served as Chair of an ABA Task Force on ADR and E-Commerce which developed guidelines for the use of ADR in electronic commerce and currently serve as chair of an ABA task force examining the use of ADR to resolve corporate governance disputes. I am a member of American Arbitration Association Law Committee which advises the AAA board on substantive arbitration issues. I am also a panelist with the National Arbitration Forum where I regularly arbitrate domain name and consumer disputes.

I have served as the Chair of the American Bar Association Section of Dispute Resolution, the Arizona Supreme Court Advisory Committee on Alternative Dispute Resolution, and the Arizona State Bar Committee on Alternative Dispute Resolution.  I teach arbitration at the Arizona State University College of Law.
